The Churchill Archive for Schools website (www.churchillarchiveforschools.com - the “CAFS Website”) is a microsite educational resource offering teachers and students an accessible entry-point to the Churchill Archive (www.churchillarchive.com - the ‘Website’).
Access to the CAFS Website is provided by Bloomsbury Academic, a division of Bloomsbury Publishing Plc (“Bloomsbury,” “we,” “our,” “us”).
This page (together with any documents referred to on it) tells you the terms on which you may make use of the CAFS Website free of charge.
Please read these terms of use carefully before you start to use the CAFS Website.
By using the CAFS Website, you indicate that you accept these terms of use and that you agree to abide by them.
If you do not agree to these terms of use, please do not access or use the CAFS Website.
Accessing our Site
Access to the CAFS Website is permitted free of charge without registration.
We will not be liable if for any reason the CAFS Website is unavailable at any time or for any period.
From time to time, we may restrict access to some parts of the CAFS Website, or the entire CAFS Website, for upgrading and maintenance purposes.
We have the right to disable any person’s access to the CAFS Website at any time without notice to you, if in our opinion you have failed to comply with any of the provisions of these terms and conditions of use.
You are responsible for making all arrangements necessary for you to have access to the CAFS Website. You are also responsible for ensuring that all persons who access the CAFS Website through your internet connection are aware of these terms, and that they comply with them.
Intellectual Property Rights
Unless otherwise stated, the Churchill Archive Centre at Cambridge University houses the original version of each of the images shown on the CAFS Website and these can be accessed by appointment.
The digital rights to the entire Churchill Archive remains with the copyright holder as appropriate but Bloomsbury has been granted appropriate licences for the purposes of use on the CAFS Website. These works are protected by copyright and other intellectual property laws and treaties around the world. All such rights are reserved.
You may download and print extracts from material on the CAFS Website for your own personal and non-commercial use only, for use in educational contexts. You must not download or print the material or extracts from the CAFS Website in a systematic or regular manner or otherwise so as to create a database in electronic or paper format comprising all or part of the material appearing on the CAFS Website. You may not distribute, transmit or disseminate any part of the material on the CAFS Website without our prior permission.
You must not modify the paper or digital copies of any materials you have printed off or downloaded in any way or create derivative versions of such materials, and you must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text.
You must retain all copyright and other proprietary notices appearing on the CAFS Website and you must not use any part of the materials on the CAFS Website for commercial purposes without obtaining a licence to do so from us or our licensors.

If you print off, copy or download any part of the CAFS Website in breach of these terms of use, your right to use the CAFS Website will cease immediately and you must, at our option, return or destroy any copies of the materials you have made.
The names, images and logos (“Trade Marks”) identifying the Churchill Archive for Schools, the Churchill Archive, Bloomsbury Academic, Bloomsbury Publishing Plc, or other third parties and their products and/or services are subject to copyright, design rights and trade mark laws. Nothing contained in these terms shall be construed as conferring any right to use any such Trade Marks.
Our Site Changes Regularly
We aim to update the CAFS Website regularly, and may change the content at any time. If the need arises, we may suspend access to the CAFS Website, or close it indefinitely. Any of the material on the CAFS Website may be out of date at any given time, and we are under no obligation to update such material.
Our Liability
While we endeavour to ensure that the information provided on the CAFS Website is accurate and up to date, the material displayed on the CAFS Website (whether provided by us or a third party) is made available without any guarantees, conditions, warranties or representations as to its accuracy, completeness or reliability. To the extent permitted by law, we, other members of our group of companies and third parties connected to us hereby expressly exclude:
- All conditions, warranties, representations and other terms which might otherwise be implied by statute, common law or the law of equity.
- Any responsibility or liability for any direct, indirect or consequential loss or damage (including without limitation loss of business, business opportunity or profits) incurred by any user in connection with the CAFS Website or in connection with the use, inability to use, or results of the use of the CAFS Website, any websites linked to it and any materials posted on it (whether caused by tort, breach of contract or otherwise, even if foreseeable).
You hereby expressly agree that you use the CAFS Website ‘as is’ and at your own risk and that any damage or loss arising from your use of it and/or any reliance placed on its contents are your sole responsibility.
This does not affect our liability for death or personal injury arising from our negligence, or any other liability which cannot be excluded or limited under applicable law.
Information About You and Your Visits to Our Site
We process information about you in accordance with our privacy policy and cookie policy. By using and/or registering with the CAFS Website, you consent to such processing and you warrant that all data provided by you is accurate.
Viruses, hacking and other offences
You must not misuse our site by knowingly introducing viruses, trojans, worms, logic bombs, spyware, adware or other material which is malicious or technologically harmful or designed to adversely affect the operation of the CAFS Website or of any computer software or hardware. You must not attempt to gain unauthorised access to the CAFS Website, the server on which the CAFS Website is stored or any server, computer or database connected to the CAFS Website. You must not attack the CAFS Website via a denial-of-service attack or a distributed denial-of service attack.
By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990 (as amended). We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use the CAFS Website will cease immediately.
We will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of the CAFS Website or to your downloading of any material posted on it, or on any CAFS Website linked to it. You acknowledge that it is your responsibility to implement sufficient procedures and virus checks to protect your computer equipment, software, data or other proprietary material.

Jurisdiction and applicable law
The English courts will have exclusive jurisdiction over any claim arising from, or related to, a visit to the CAFS Website although we retain the right to bring proceedings against you for breach of these conditions in your country of residence or any other relevant country.
These terms of use and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the law of England and Wales.
Variations
We may revise these terms of use at any time by amending this page. You are expected to check this page from time to time to take notice of any changes we may have made, as they are binding on you and your continued use of the CAFS Website will be deemed acceptance of the updated or amended terms. Some of the provisions contained in these terms of use may also be superseded by provisions or notices published elsewhere on the CAFS Website.
Severance
If any of these terms are deemed to be illegal, invalid or otherwise unenforceable by reason of the laws of any state or country in which they are intended to be effective, then to the extent and within the jurisdiction in which any term is determined illegal, invalid or unenforceable, it shall be severed from these terms and the remaining terms shall survive and continue to be binding and enforceable.
